Terms of Service

Welcome to Zenith Marketing Intelligence. These Terms of Service ('Terms') govern your access to and use of the services, websites, and applications offered by Zenith Marketing Intelligence Sp. z o.o. ('Zenith', 'we', 'us'). By accessing or using our Services, you agree to be bound by these Terms.

1. Definitions

'Services' refers to the data analysis, market intelligence reports, platform access, and consulting provided by Zenith.

'User' or 'You' refers to the individual or entity that has registered for an account to use the Services.

'Content' means any data, reports, text, graphics, or other materials provided by Zenith through the Services.

2. Services and License

Subject to your compliance with these Terms, Zenith grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services and Content for your internal business purposes only. You may not resell, redistribute, or use the Services or Content for the benefit of any third party.

3. User Obligations

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to use the Services in compliance with all applicable laws and regulations. You shall not (a) decompile, reverse engineer, or otherwise attempt to derive the source code of the Services; (b) use the Services to store or transmit infringing, libelous, or otherwise unlawful material; or (c) interfere with or disrupt the integrity or performance of the Services.

4. Payments and Subscriptions

Services are provided on a subscription basis. Fees are specified at the time of purchase and must be paid in advance. Subscriptions will automatically renew for successive periods unless terminated by either party. All fees are non-refundable, except as required by law.

5. Intellectual Property

Zenith and its licensors own all right, title, and interest in and to the Services and Content, including all related intellectual property rights. No rights are granted to you hereunder other than as expressly set forth herein.

6. Limitation of Liability

To the maximum extent permitted by law, in no event shall Zenith be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services. In no event shall Zenith's aggregate liability exceed the amount you paid Zenith, if any, in the past six months for the services giving rise to the claim.

7. Governing Law

These Terms shall be governed by the laws of the Republic of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Warsaw, Poland.

8. Final Provisions

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice of such changes, such as by sending an email, providing a notice through our Services, or updating the 'Last Updated' date. Your continued use of the Services will confirm your acceptance of the revised Terms.
